Terms of Service

These Terms of Service (“Terms”) form a binding agreement governing your access to and use of BookMyChat (“BookMyChat”, “we”, “us”, “our”), a WhatsApp-based appointment booking service. By creating an account or using the service, you agree to these Terms. If you are using BookMyChat on behalf of a business, you represent and warrant that you are authorised to accept these Terms for that business, and “you” refers to that business. If you do not agree, do not use the service.

The service

BookMyChat lets a business take, reschedule, and cancel appointments over WhatsApp, manage those bookings on a dashboard, and send booking-related reminders. Features may be added, changed, suspended, or removed at any time. We may set or change usage limits.

Accounts

• You must provide accurate information and keep your login credentials secure.
• You are responsible for all activity under your account and by your staff or agents.
• You must be legally able to enter into these Terms and operate a legitimate business.

Free trial

New accounts include a free trial period during which no payment is required. When the trial ends, continued use requires an active paid subscription. If you do not subscribe, access to the dashboard and the WhatsApp booking assistant will be paused. We may change or withdraw trial terms at any time.

Subscriptions, billing, and coupons

• Paid plans are billed in advance on a recurring basis through our third-party payment processor, including through recurring payment mandates (such as UPI AutoPay) that you authorise. You authorise us and our payment processor to charge your selected payment method for all applicable fees until you cancel.
• A coupon, where issued by us, applies a discounted price for its stated validity. When the coupon expires, the standard price applies automatically from the next billing cycle.
• Your plan may automatically move to a higher tier when your booking volume exceeds your current tier’s limit; we surface this on your billing page.
• You may cancel at any time; cancellation takes effect at the end of the current billing cycle. Except where required by law, all fees are non-refundable and there are no refunds or credits for partial periods, downgrades, or unused features.
• We may change prices or fees with reasonable prior notice, effective from your next cycle. Taxes, where applicable, are your responsibility and may be added.

WhatsApp, Meta, and your messaging responsibilities

BookMyChat operates on the WhatsApp Business Platform provided by Meta. Your use of WhatsApp through BookMyChat is also subject to Meta’s and WhatsApp’s terms and policies, which may change and which you agree to comply with. You are solely responsible for:

• messaging your customers lawfully, with a valid basis and all required consents and opt-ins under applicable laws and regulations (including telecom, anti-spam, data protection, and consumer-protection rules);
• the accuracy and legality of your services, pricing, content, and communications;
• obtaining and maintaining any registrations required to send messages in your jurisdiction.

Certain messages may be charged by Meta; those charges are governed by your arrangement with Meta or, where applicable, billed through your BookMyChat plan as described at sign-up. We are not responsible for Meta’s decisions, fees, rate limits, message deliverability, number bans, or availability.

Acceptable use

You agree not to use BookMyChat to:

• send spam, unsolicited marketing, or unlawful, harmful, deceptive, or infringing content;
• violate any law or the rights of others, including privacy, IP, and consumer rights;
• attempt to disrupt, reverse-engineer, probe, or gain unauthorised access to the service;
• resell, sublicense, or provide the service to third parties except as expressly permitted.

We may investigate and take action, including suspension, for any suspected violation.

Your data and customer data

You retain ownership of your business data and your customers’ data. You grant us a worldwide, non-exclusive licence to host, process, and use that data as needed to provide and improve the service. Our handling of personal data is described in our Privacy Policy. You represent and warrant that you have all rights, consents, and legal bases necessary to collect and process your customers’ information through BookMyChat, and that our processing on your instructions will not breach any law or third-party right.

Service availability

We aim to keep the service available and reliable but do not guarantee uninterrupted or error-free operation. The service depends on third parties (including the WhatsApp Business Platform, payment processors, and hosting providers) and may be affected by their availability, changes, or maintenance. We may perform maintenance or modify the service at any time.

Disclaimers

To the fullest extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or that it will meet your requirements, or that any bookings, messages, or reminders will be delivered on time or at all.

Limitation of liability

To the maximum extent permitted by law, in no event will BookMyChat, its owners, or its personnel be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business, arising out of or relating to the service, whether in contract, tort, or otherwise, even if advised of the possibility. Our total aggregate liability for all claims relating to the service will not exceed the amount you actually paid us in the three (3) months immediately before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, in which case the above applies to the extent permitted.

Indemnification

You agree to indemnify, defend, and hold harmless BookMyChat, its owners, and its personnel from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the service; (b) your content, services, or communications, including messages sent to your customers; (c) your violation of these Terms, any law, or any third-party right; or (d) your failure to obtain required consents or registrations from or for your customers.

Suspension and termination

We may suspend or terminate access, with or without notice, if you breach these Terms, fail to pay, create risk or legal exposure, or if required by a third-party platform or by law. On termination, your right to use the service ends. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.

Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, outages or actions of third-party platforms or providers, internet or telecom failures, cyber-attacks, strikes, or governmental action.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use after changes take effect means you accept the revised Terms.

Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-laws rules. The courts located in India will have exclusive jurisdiction over any dispute, and you consent to that jurisdiction and venue, unless a mandatory local law provides otherwise.

General

These Terms and the Privacy Policy are the entire agreement between you and us regarding the service and supersede prior agreements. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
